U.S. District Judge Waverly Crenshaw on Friday dismissed federal human-smuggling charges against Kilmar Abrego Garcia, a Salvadoran man who was mistakenly deported to El Salvador last year. Crenshaw granted Abrego Garcia's motion to dismiss for selective or vindictive prosecution after earlier finding evidence that the prosecution may have been vindictive and noting connections to his successful suit challenging removal. The judge concluded prosecutors failed to rebut the presumption of vindictiveness, writing that the record "sadly reflects an abuse of prosecuting power." Abrego Garcia issued a statement saying he was grateful that "justice has taken a step forward." The dismissal increases scrutiny of Justice Department charging decisions and follows public comments by administration officials when the charges were first announced last year.
