Federal Trade Commission and 22 states sue Amazon over inflated advertising prices

The Federal Trade Commission and 22 states sued Amazon on Monday, alleging the retailer secretly inflated prices in its digital advertising auctions. The complaint, filed in federal court in Washington state, says Amazon overcharged more than 1.2 million advertising customers for more than seven years, including more than 500,000 small and midsize businesses. Regulators allege Amazon represented that winning advertisers generally paid only enough to beat the next-highest bid, but secretly added surcharges that raised prices. The complaint says the alleged scheme likely extracted more than $20 billion from advertisers. Amazon denies wrongdoing, calling the lawsuit misguided and saying the FTC relies on simplified communications that misrepresent its auction system. Amazon says average Sponsored Products cost-per-click remained flat after inflation from 2019 through 2024 while advertising performance improved. The case seeks injunctions, penalties, disgorgement and restitution. No judge has yet ruled on the allegations, and the litigation remains pending currently.
