Judge deals blow to Trump moves to deport pro-Palestinian activists

A federal judge in San Jose, California, ruled unconstitutional the federal laws used by the Trump administration to cancel visas and deport noncitizen college students for pro-Palestinian advocacy. U.S. District Judge Noel Wise criticized the State Department and Department of Homeland Security for deploying immigration provisions to target constitutionally protected speech and dissent. The lawsuit, initiated in August 2025 by Stanford University’s student newspaper, argued that visa revocations under immigration laws violated First and Fifth Amendment rights by forcing students and journalists into self-censorship. Judge Wise concluded that targeting individuals based on political viewpoints undermines democratic foundations. The decision mirrors a similar ruling by a Boston federal judge last year against administration policies targeting campus activists. Government agencies did not immediately respond to requests for comment. The ruling provides protections for noncitizen students engaging in political speech, limiting executive authority regarding visa cancellations based on foreign policy interests.
