Ninth Circuit clears path for Portland Guard

A divided Ninth Circuit lifted a Portland judge’s restraining order, clearing the way for the Trump administration to send federalized National Guard troops to Portland. The majority said it is likely the president lawfully acted under 10 U.S.C. §12406(3) and faulted the district court for discounting violence outside a local ICE facility earlier in the summer. Judge Susan Graber dissented, saying there was no justification. The White House applauded the ruling; Oregon’s attorney general warned it grants near‑unilateral power. An Illinois deployment remains temporarily blocked.
