Comey’s lawyers asked a federal judge in Alexandria, Va., to dismiss perjury and obstruction charges, arguing prosecutors misused the grand jury and accused him of a lie he never told. In new motions, they say Senator Ted Cruz’s hearing questions were ambiguous and Comey’s answer was literally true, undercutting the perjury count. They also challenge prosecutor Lindsey Halligan’s appointment and allege irregularities in her first grand jury presentation. Prosecutors from North Carolina have two weeks to respond. A Nov. 13 hearing will address the appointment challenge alongside a related bid by New York Attorney General Letitia James.
