Defense moves to dismiss death-penalty charge

Lawyers for Luigi Mangione asked a Manhattan federal judge to toss several counts—chiefly the sole charge carrying the death penalty—and to suppress his statements and a backpack with a gun and ammunition, saying he wasn’t read his rights and the search lacked a warrant. Mangione, 27, has pleaded not guilty in the Dec. 4 shooting of UnitedHealthcare CEO Brian Thompson as he arrived at a Manhattan hotel for his company’s annual investor conference. Arrested five days later after a tip in Altoona, Pa., he’s held without bail. Defense papers also dispute stalking as the required predicate.
