Underserved Communities Again Ask Courts to Restore Justice Grant Funding

Plaintiffs representing marginalized communities returned to federal courts in a final effort to rescue three billion dollars in environmental and climate justice grant funding. The grants, originally established under the 2022 Inflation Reduction Act, were canceled by the Trump administration during a rollback of federal environmental and equity initiatives. In July, a federal district judge ruled that the Environmental Protection Agency acted unlawfully by terminating the program and ordered administration to resume before a September 30 expiration deadline. However, a three-panel Fourth Circuit Court of Appeals later granted the federal government a stay, halting fund disbursements during appeal. Plaintiffs filed petitions asking the full bench of the Fourth Circuit to overturn the stay and requested a South Carolina federal district court to freeze the expiration deadline. Advocates warn that the prolonged legal battle threatens local infrastructure projects and could discourage vulnerable communities from applying for future federal grants.
