The U.S. government is refunding $81 billion in customs duties to importing companies in the current fiscal year after a Supreme Court ruling invalidated a major portion of former President Donald Trump’s global tariff program. In a February 2026 decision, the Court held that the tariffs exceeded presidential authority under the International Emergency Economic Powers Act. A Treasury official said the surge in repayments, largely processed in May and June 2026 via a dedicated Customs and Border Protection portal, has significantly worsened federal finances. Newly released budget data show June’s deficit reached $120 billion, including a net customs duty outflow of $25.6 billion.
