The U.S. Department of Justice has asked a federal court in Mississippi to intervene in and dismiss a civil rights and environmental lawsuit against Elon Musk’s artificial intelligence company xAI and MZX Tech LLC. The suit, filed in April by the NAACP and other groups in the Northern District of Mississippi, alleges xAI is illegally operating dozens of portable natural gas turbines without required Clean Air Act permits to power a $20 billion AI data center near North Mississippi and the Memphis area. In a motion filed late Monday, DOJ argued the facility is tied to national, economic and energy security and that federal enforcement discretion takes precedence over citizen suits seeking civil penalties.
