Southaven, Mississippi, residents have filed a federal class-action lawsuit against Elon Musk’s xAI and its subsidiary MZX Tech, alleging that a gas-fired power plant serving nearby artificial intelligence data centers generates an “omnipresent and inescapable” nuisance through excessive noise and vibrations. Filed in federal court in Oxford, Mississippi, and made public on Tuesday, the complaint claims that the power plant has harmed the health and quality of life of people living nearby and has reduced local property values. The plaintiffs estimate that more than 10,000 residents could be part of the class and seek damages for emotional distress, diminished property values, and disgorgement of profits allegedly earned from the project. Southaven, Mississippi, is home to the power project, which uses gas-fired turbines and is part of a more than $20 billion AI-related infrastructure investment supported by Mississippi Governor Tate Reeves. The lawsuit asserts that the AI boom is “wreaking havoc” on the community by subjecting residents to near-constant noise pollution and compromising what attorneys describe as the fundamental peace and security of their homes. The case follows a separate lawsuit filed in April by the NAACP that accuses xAI of violating U.S. environmental rules, in which the U.S. Justice Department has indicated it may intervene.
