The Environmental Protection Agency approved two new photoacid generators for data center semiconductor manufacturing despite internal warnings indicating exposure risks include sudden death. Earthjustice filed a lawsuit alleging the approvals violate the Toxic Substances Control Act because the agency conceded insufficient data exists to determine safe exposure thresholds or lethal limits. The substances are suspected per- and polyfluoroalkyl substances that resist environmental breakdown and threaten water supplies and worker safety. Internal consent orders show the agency acknowledged unreasonable public health risks while granting permits under an executive order aimed at accelerating data center infrastructure. The manufacturer identity remains redacted in public filings, preventing independent verification of contamination levels. Environmental advocates argue the fast-tracked approvals undermine fundamental regulatory protections.
