Idaho must allow abortions to preserve women's health, US judge rules

A federal judge in Idaho ruled Thursday that the state’s near-total abortion ban is unconstitutional because its health exceptions are too narrow. U.S. District Judge B. Lynn Winmill said the Fourteenth Amendment protects access to abortion when necessary to preserve a pregnant woman’s health, including serious physical or mental-health risks short of death. The ruling came in a lawsuit brought by Dr. Stacy Seyb, a Boise maternal-fetal specialist, against Idaho officials. Winmill said Idaho may not enforce its abortion restrictions against physicians providing health-preserving care covered by the decision. He did not invalidate the state’s entire abortion ban and upheld restrictions involving fetal life-limiting conditions when the pregnant patient’s health is not seriously threatened. Idaho Attorney General Raúl Labrador said he plans to appeal, arguing the ruling creates a new constitutional abortion right. The decision could become an important test of abortion rights after the Supreme Court’s 2022 Dobbs ruling.
