Tesla has secured a UK Supreme Court ruling allowing it to revive a London High Court lawsuit over licensing terms for 5G patents ahead of its planned launch of 5G-enabled vehicles in Britain. The electric carmaker sued U.S. technology company InterDigital and patent licensing platform Avanci in 2023, asking the High Court to set fair, reasonable and non-discriminatory (FRAND) terms for a licence to use standard-essential patents. After lower courts sided with InterDigital and Avanci, Tesla appealed to the Supreme Court. The court held that patent owners remain bound by FRAND obligations even when licensing through a patent pool, sending the case back to the High Court.
