What to Know About Trump’s Transgender Passport Policy After Supreme Court Ruling

On Thursday, the Supreme Court allowed the Trump administration to halt issuing passports that reflect the gender identity of transgender, nonbinary, and intersex Americans, temporarily permitting a policy requiring passports to list sex assigned at birth while lower courts weigh its legality. Existing passports that reflect gender identity, including those with the gender neutral X marker, remain valid until they expire, the ACLU said. The rule applies to first time applications and renewals, ends a Biden era option, and will require renewing holders to use the sex they were assigned at birth.
