On Wednesday, the Supreme Court will hear challenges to President Donald Trump’s “Liberation Day” tariffs, imposed after he declared a national emergency and sought at least 10% duties on nearly every country. The justices will decide whether the Carter-era International Emergency Economic Powers Act lets a president levy tariffs—and, if so, whether that intrudes on Congress’s Article I taxing authority. Lower courts said IEEPA doesn’t authorize the duties. Two cases from small businesses and twelve states are at issue. If upheld, the IEEPA tariffs could raise four times the revenue of Trump’s other tariffs.
