A federal appeals court on Thursday kept a block on President Trump’s plan to deploy National Guard troops within the Chicago area amid immigration protests, while allowing the soldiers to remain under federal control. In a unanimous 18-page ruling, the 7th Circuit said the administration is unlikely to justify federalizing the Guard under Title 10, finding insufficient evidence of a rebellion or that regular forces cannot execute the law. Judges noted federal facilities, including Broadview’s processing center, remain open. Illinois and Chicago have sued; the administration argues such decisions aren’t reviewable.
