The Court of Justice of the European Union issued two advisory rulings after courts in Austria and Spain asked for guidance, siding with the airlines in both. In a delay claim against Austrian Airlines, the CJEU said a lightning strike can be an “extraordinary circumstance” limiting liability if the carrier proves it took all reasonable measures, noting mandatory safety inspections. In a separate case over a dog lost in Buenos Aires, the court held pets in the hold count as baggage, so compensation follows baggage rules unless a special declaration is made. The claims sought €400 and €5,000.
