J.M. Smucker Co. has sued Trader Joe’s in federal court in Ohio, accusing the grocer’s frozen PB&J sandwiches of mimicking Uncrustables’ round, crustless design, crimped edges, blue box lettering, and even a bitten-sandwich image. Smucker seeks restitution and a court order to destroy products and packaging, citing more than $1 billion invested in the brand. A message seeking comment was left with Trader Joe’s. An IP attorney noted Smucker’s trademarks could help, while Trader Joe’s may argue the crimping is functional and the sandwiches appear slightly more square. Smucker also alleges consumer confusion online.
