OCR determined these policies violate the sex-based protections of Title IX, citing concerns over student safety and the potential for inappropriate behavior. The OCR issued a proposed Resolution Agreement, requiring the districts to rescind these policies, issue a clarifying memorandum, and adopt biology-based definitions of 'male' and 'female'. The districts have 10 days to comply or face enforcement action.
