A divided 9th Circuit panel lifted a lower court order and said President Donald Trump could federalize 200 Oregon National Guard members to protect an ICE facility in Portland. The 2-1 majority, Judges Ryan Nelson and Bridget Bade, found it likely the president acted within statutory authority, citing disruptions by protesters. In dissent, Judge Susan Graber warned of “illegal deployment” under false pretenses, arguing the record showed no inability to execute immigration laws and that the statute covers invasion, rebellion, or genuine inability.
