District Judge J. Michael Seabright ruled Tuesday that Bill Essayli unlawfully stayed on as acting U.S. attorney in the Central District of California past a 120-day limit, effective July 31. He disqualified Essayli from the role but let him remain “first assistant,” leaving day-to-day control largely intact; Essayli posted, “Nothing is changing.” It’s the third court rebuke of Trump-aligned appointments, after similar rulings in New Jersey and Nevada. Seabright kept existing cases intact, but his reasoning could imperil indictments against James Comey and Letitia James tied to a disputed Virginia appointment, with arguments set Nov. 13.
